Summary of Ordinance 2026-3 Zoning Ordinance Changes and Additions

Enacted September 14, 2026

An ordinance of the Board of Commissioners of Highland Beach amending the Highland Beach Zoning Ordinance by

Amending Section 2-2 “Definitions” to add definitions of long and short-term rentals and two-and-one-half story buildings;

Adding a new Section 4-6 “Accessory Dwelling Units”;

Amending Section 5-6 “Height Exceptions of Maximum Regulations” by adding prohibited uses of roofs;

Amending Section 5-12 “Swimming Pools” to prohibit above ground pools;

Adding a new Section 5-13 “Hot Tubs” authorizing and regulating their use;

Adding a new Section 5-14 “Roof Top Decks” regulating their use;

Amending Section 7-4 “Notice of Hearings” authorizing notice on the town’s website.
